Uncontested Divorce
Where both parties agree but one spouse does not want to go to or cannot go to the final hearing.
Both Sign Papers
Both parties agree on the terms of divorce. They sign a Separation Agreement and a final Judgment Entry which are adopted by the Court.
The spouse who filed the case must attend the final hearing (or attend via Zoom if it is the rule of the Court).
The basis for the divorce (such as incompatibility or a one-year period of separation) is corroborated by a witness. This can be a friend or a family member.

The final hearing is set a minimum of 42 days after the date of the filing of the case. A common period of time is 60-70 days if there are no minor child(ren) of the marriage and 90-100 days if there are minor child(ren) of the marriage.




If there are minor child(ren):
The Complaint for Divorce.
A Waiver to be signed by spouse acknowledging receipt of the divorce papers and consenting to the matter being set for final uncontested divorce.
The Separation Agreement setting forth the terms of the divorce.
The final Judgment Entry for Divorce.
Papers Prepared in an Uncontested Divorce
The Parenting Plan for the minor children of the parties.
The Child Support Computation Worksheet (required even if there is no child support)..
The Parenting Proceeding Affidavit as to the residency of the children for the past five years.
The Health Insurance Affidavit regarding medical coverage of the minor children.
The form requesting the services of the Child Support Enforcement Agency (required even if there is no child support).
